看过“INSTAGRAM API TERMS OF USE”，首先说明两点，1.“The Terms of Use and the relationship between you and Instagram shall be governed by the laws of the State of California without regard to its conflict of law provisions” 说明该使用条款的管辖法律为美国加州法律，关于该商标也应该是参考美国商标法案，这两个我都不了解。所以我不能从美国法的角度解释这个问题。好在商标法方面我国都是在借鉴（貌似其它法律也是哈），所以大同小异，我试着从中国商标法的角度分析一下哈。2. 我能从商标法角度解释 “While you cannot use the word "Instagram" or "IG" in your product's name, it's ok to use one (but not both) of the following: "Insta" or "gram"” 即为什么可以单独使用"Insta" 或"gram"，但不能同时使用"Insta" 和 "gram"，但找不到“don't Use “Instagram,” “IG”, “Insta” or “Gram” in your app name”的法律依据，只能从其它方面揣测一下哈。下面开始回答1. 为什么可以单独使用"Insta" 或"gram"，但不能同时使用"Insta" 和 "gram"？这涉及到近似商标判定的问题。“InstaXXXX” 或“XXXXgram”都不构成“Instagram”的近似商标，但如果是“InstaXXgram”或“InstagramXX”等就会构成“Instagram”的近似商标，从而有可能构成商标侵权。2. 猜测“Instagram 为何禁止第三方应用名字包含 “insta” 或者 “gram” 字样”。a) 不太了解应用的图标及商标的使用是怎样的，但根据我浅薄的想象，一般应用的图标都比较小，设计者尽可能会简化自己名称以便在有限的空间内展示自己的名称，用户也会根据简单的字样联想到某一品牌。例如，我们有新浪微博，腾讯微博等，如果单单看到一个应用名称是“微博”，用户可能会先入为主地认为是某微博。因为应用这个玩意是近几年才兴起的，法律方面的规定是滞后的，单纯的商标法是不能保护商标人的权利的，因此权利人只能通过这样的条款来限制第三方的使用从而避免"suggest that Instagram sponsors or endorses their product"。b) 该条款并不是针对所有的使用者，而是针对“instagram developers”, 可见这样的禁止性条款对一般的使用者或许是没有效力的（不知道美国商标法案有没有相关的规定），但instagram通过与第三方的合作关系或合作协议来约束第三方，要求第三方要与我合作就得遵守约定，从而避免类似女人被小弟或兄弟抢走的悲剧发生吧。
没有专门研究过Instagram的相关消息。只常规的品牌保护角度来讲，这样做可以避免用户误认为这些带有“insta” 或者 “gram” 字样的应用和Instagram有密切关系（如认为是Instagram平台推出的子产品等），从而避免对Instagram品牌声誉的蓄意利用或伤害。虽然对商标的侵害可以通过起诉等方式抗止，但这种耗时久还有失败风险的事情，显然不如在自己可控的范围内直接禁止来的快速、省事。
